On very first day, when notices were issued, learned counsel appearing for the petitioner had pointed out that the matter is covered by decision of this Court in Writ Petition No.4925 of 2015 reported at 2016(1) ALL MR 875 (M/s Nagpur Distillers Pvt.Ltd. ..vs.. State of Mah. and anr.).

Advocate Shri Kasat, who appears for respondent no.2 - Nagpur Municipal Corporation does not dispute this.

Learned AGP, however, is seeking further time of two weeks.

As we find that controversy is already answered against petitioner and one of us (B.P.Dharmadhikari, J.) is party to that adjudication, we dispose of the present challenge also in terms of
