Heard learned counsel for the rival parties. Seen the statements of the witnesses as well as that of the complainant.
The girl is admittedly fifteen years' old, and by committing criminal trespass, a gang rape was committed by the applicant and the co-accused. Thus, a prima facie case is made out against the applicant. Hence no bail can be granted.
In the circumstances, Criminal Application [BA] No. 856 of 2015 is rejected.
