Heard learned counsel Shri R.R. Prajapati for the applicant and learned Additional Public Prosecutor Shri V.P. Maldhure for the nonapplicant/State. The applicant is convicted for the offences punishable under Section 302 of the Indian Penal Code and other provisions and is undergoing sentence. As such, his request to condone delay of 123 days in filing the criminal appeal under Section 374 of the Code of Criminal Procedure challenging that conviction is granted.
As we do not see any mala fide, we have rejected request made by learned Additional Public .....2/-
Prosecutor Shri V.P. Maldhure to grant him time to verify the facts.
