DATED : 23-01-2025 The petition seeks a relief to declare a DP road reservation which passes through Khasra No. 109, Mouza Somalwada, Nagpur in the layout of Jaihind Co-Operative Society Ltd., as illegal on account of the fact that the petitioner has been sold plots by the Society which is lying on the DP road reservation. 2.
Sec. 3(2)(b) of the Maharashtra Gunthewari Developments (Regularisation, Upgradation and Control), Act, 2001 ("the Act"), mandates that the required DP road in the areas of Municipal Corporation has to be maintained, which would indicate, that any Gunthewari Development in this DP road reservation area cannot be regularized. It is not disputed by the learned Counsel for the petitioner that the land of the petitioner falls within the DP road reservation, in view of which, considering the mandate of Section 3(2)(b) of the Act, we do not see any reason to entertain the petition. The petition is dismissed. No costs.
