Considering the nature of evidence on record as well as in the light of the prima-facie consideration of the impugned judgment, the respondent is permitted to withdraw an amount of Rs.Two Lakh as deposited by the petitioner subject to filing of an undertaking that in case the writ petition is allowed, the amount withdrawn shall be re-deposited with interest at such rate the Court may direct. Civil Application is disposed of.
