The appellant has filed this application stating that there is delay of 687 days in filing the appeal and praying that it be condoned for the reasons stated in the application. Today, an affidavit is filed on behalf of the appellant stating that the delay in filing the appeal is of 322 days and not 687 days and that while drafting the civil application the mistake was committed in calculations. The application is not opposed inasmuch as the claimant has not appeared. Accepting the reasons stated in the application, which are not controverted, the delay in filing appeal is condoned. The civil application is allowed. JUDGE Tambaskar.
