This is an application for releasing amount of Rs.3,03,450/- and Rs.1,61,000/- along with Bank Guarantee furnished by the applicant.

Perused the application.

Heard the learned advocate for both sides.

Learned advocate for applicant pointed out that the Bank Guarantee No.BG/30/2009 dated 15.10.2009 for Rs.85,000/- i.e. 2% interest of the amount of compensation was furnished, it deserves to be discharged.

On perusal of this application, it is clear that First Appeal No.590/2005 is decided by this court. The application therefore deserves to be allowed in terms of prayer clauses (a) to (c). The application is allowed.

Registry is directed to pay that amount accordingly along with interest accrued thereon to the applicant. 7.

The application is allowed and disposed of.
