Since the issue involved in these writ petitions is identical, they are heard together and are decided by this common order.
By these writ petitions, the petitioners have sought a direction to the State Government to frame the policy for absorption of the part time instructors that have served in the middle schools with the strength of more than hundred students. Consequently, the petitioners have challenged the advertisement issued by the Zilla Parishad, Yavatmal for appointment of part time instructors.
Shri Patil, the learned Assistant Government Pleader appearing on behalf of the respondent-State, states that the Government of Maharashtra has framed the policy in regard to the appointment of the part time instructors like the petitioners by the Government Resolution dated 07.10.2015. It is stated that the petitioners would now be governed by the Government Resolution dated 07.10.2015.
WPs5958&7267-14 Ms Biala, the learned counsel for the petitioners, states that in view of the said development, the cause of filing the writ petitions would not survive. It is, however, stated that if the petitioners are aggrieved by the Government Resolution, they would take appropriate steps for challenging the same. In view of the statements recorded hereinabove, we dispose of the writ petitions, with no order as to costs. The points raised in the petitions are however kept open.
