Heard learned Counsel for the applicant and for nonapplicant No.1. None for non-applicant No.2 though served. This application is filed for condonation of 243 days delay caused in preferring appeal against the impugned award dated 29.10.2014 passed in M.A.C.P. Case No.364/2010 by M.A.C.T. Amaravati. For the grounds mentioned in para Nos. 3 and 4 of the application, same is liable to be allowed as it is found that there is no intentional delay in filing appeal. The same is therefore allowed.

This application is for condonation of 685 days delay caused in taking step to bring on record legal representatives of respondent No.3. The grounds mentioned for causing delay, is found to be satisfactory.

This application is for setting aside order of abetment and for permission to bring on record legal representative of respondent No.3. This Court had allowed the application filed for condonation of delay and has condoned the delay caused in taking steps to bring on record legal representatives of respondent No.3. In that view of the matter, order of abetment is liable to be set aside by bringing on record legal heirs of deceased respondent No.3. In the circumstances C.A. is disposed of.
