It is a common ground that the cross-objection has already been decided alongwith Second Appeal No.519 of 2011.

Perusal of judgment dated 28.04.2025 more particularly para 11 goes to show that this Court has opined that the cross-objection is not maintainable and by the said judgment the appeal came to be allowed. However, in operative order, dismissal of the cross-objection is not reflected.

In view of the findings of this Court in judgment dated 28.04.2025 in Second Appeal No.519 of 2011, the cross-objection stands dismissed.
