Heard learned counsel for rival parties.

The petitioner was convicted for the offence punishable under Section 302, Indian Penal Code, and sentenced to Life Imprisonment. Thereafter, this Court in appeal brought down the sentence to ten years. The petitioner was arrested in 2010. Thereafter, he has availed various leaves on three occasions. In 2013, he surrendered late by 287 days. This apart, from inception, the petitioner has remained out of jail when his place is actually in jail. That being so, we make the following order:-

O R D E R

Criminal Writ Petition No. 937 of 2014 is dismissed.

Fees payable to learned Adv.

[appointed] for the petitioner are quantified at Rs.1500-00 [rupees one thousand five hundred only].
