Rule made returnable forthwith. Heard finally by consent of learned Counsels appearing for the parties. 2.

Let there be no impression that, out-station Counsels are enjoying exemption from the matters being dismissed in default by the Courts. We think that this warning is sufficient to restore the matter. The petitioner and his Counsel have given an undertaking before us that the matter shall be regularly attended before the Maharashtra Administrative Tribunal.

In view of above, the Writ Petition is allowed. The order dated 7.8.2019 passed in M.C.A. No.33 of 2018 in O.A. No.189 of 2010 by the Maharashtra Administrative Tribunal, Bench at Nagpur is hereby quashed and set aside. 4.

The parties to appear before the Maharashtra Administrative Tribunal on 11.12.2019.
