This is an application for grant of bail.

Heard learned counsel for the applicant. The applicant is charged with the offences punishable under Sections 376(3) 376(2)(n), 452 of the Indian Penal Code, 1860, and under Sections 4, 6, 8 and 10 of the Protection of Children from Sexual Offences (POCSO) Act. On perusal of the entire investigation papers, it reveals that not only the allegation is of a sexual assault, but the allegation is that the obscene videos of the actual act were uploaded by the present applicant on Instagram as well as the same were found in his mobile phone. Considering that when first incident was taken place, she was only 12 years of age, and a very tender age girl is subjected for the sexual assault, and uploading the photographs of the videos on the social side is admittedly a serious offence, therefore, I have shown my disinclination to grant bail.
