Heard Ms. Rakhi Sarkar, learned counsel for the applicant/petitioner and Ms. M.H. Deshmukh, learned A.P.P. for respondent.

It appears that 40th day function after death on 28.09.2016, is to be performed on 30.10.2016. Learned A.P.P. points out that she has still not received necessary instructions. However, she states that applicant/prisoner has reported back and is currently lodged in Central Jail, Nagpur.

Today is the last working day before 30th October, 2016. Hence, considering the religious nature of ceremony, we direct the nonapplicant to arrange to take the applicant to Gadchandur and bring him back after attending the function, at the earliest. Costs therefor shall be incurred by the applicant/his family.

Criminal Application is therefore, partly allowed and disposed of. No costs.

Copy of this order be furnished to the learned Counsel for the parties to act upon.
