Heard learned counsel Shri R.M.Daga for the applicant and learned Additional Public Prosecutor Shri S.M.Ghodeswar for the State.

The applicant is arrested on 28.4.2019 in connection with Crime No.348/2019 registered with Kalamana Police Station, District Nagpur for offence punishable under Section 376 of the Indian Penal Code.

Learned counsel Shri R.M.Daga for the applicant submitted that though case is committed to Court of Sessions, charge is not framed.

First Information Report lodged by victim herself who is a married woman.

Since investigation is over, in my view, further custodial presence of the applicant is not necessary. Hence, I pass following order.
ORDER
(a) The criminal application is allowed.

ba932.19 26 (b) Applicant-Kamlesh s/o Kalaram Verma, in connection with Crime No.348/2019 registered with Kalamana Police Station, District Nagpur for offence punishable under Section 376 of the Indian Penal Code, be released on bail on he executing a P.R.Bond in the sum of Rs.25,000/- with one solvent surety of the like amount.
(c) The applicant shall attend the police station twice in a month that is on 1st Sunday and 3rd Saturday of each month and shall be in the police station from 11:00 a.m. to 3:00 p.m.. (d) With this, the criminal application stands disposed of. JUDGE !! BRW !!
