Date : 15 th DECEMBER, 2015 Shri Chavan for the petitioners seeks leave to withdraw the petition with liberty to press prayer (ii) again if cause of action arises. He points out that allotment of tender to M/s Diamant Infrastructure Ltd. has been cancelled and tender process itself has been withdrawn.
AGP appears for respondent no. 1/State. Advocate Deogade h/f Advocate Mishra for respondent no. 2 is present. Shri Chavan points out that prayer (ii) to claim precedence for development of community centre in their lay-out cannot be gone into as a cause in Public Interest Litigation and if any such cause of action accrues, the petitioners should be permitted to press the

In this situation, with liberty as prayed for, we dispose of PIL as it has become infructuous.
