By this application, the applicant is seeking condonation of delay which is caused in preferring the application for leave to file appeal under Section 378(4) of the Cr.P.C.

Considering the reasons mentioned in the application that in the first week of June, 2023 the appellant was not keeping good health, and therefore, he could not file the appeal in time, hence the delay of 3 days is caused.

The reasons appears to be reasonable and justifiable one for causing of the delay.

The application is allowed and the delay is condoned.

5.

The application is disposed of.
