The applicants are arrested in Crime No.639/2025 registered at Police Station Katol, District Nagpur for the offences punishable under Sections 109, 115(2), 118(1), 189(2), 190, 193(3) of the Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution in brief is as under : The incident took place on 09.08.2025. The informant was sitting with his friend near the water tank of their village. It is alleged that all the family members namely Pramil Raut, Shamrao Sonwane, Anita Sonwane, Janabai and one juvenile including the applicants came there and assaulted the informant by means of sticks. The juvenile assaulted the informant with knife. The allegations are made that these applicants have assaulted with wooden sticks. On the complaint lodged by the informant, the crime is registered.

The learned Counsel for the applicant has stated that except these two applicants, all the other co-accused are released on bail. The applicants came to know that there is scuffle between the juvenile and the co-accused and therefore, they went there to see and all of them are implicated in this case. Hence, prayed to release the applicants on bail.

The learned A.P.P. opposed the applications stating that the injured was in hospital for near about eight days. There is injury on the vital part, all other accused were present there. Considering the nature of the offence, prayed to reject the application.

Heard both the learned Counsel for the respective parties.

The other co-accused, who are having similar role are released on bail by the Trial Court. As the applicants were holding stick and assaulted with said stick, the application of these two applicants were rejected by the Trial Court.

Considering the role played by these applicants and as the other co-accused are already released on bail, the injured is discharged, further custody of these applicants is not required. Accordingly, I proceed to pass the following order :
i] The criminal application is allowed.
ii] The applicant in Criminal Application (BA) No.1028/2025 namely Ravi @ Ravindra Manohar Raut and the applicant in Criminal Application (BA) No.1029/2025 namely
3 36.ba.1028.25 Shamrao Laxmanrao Sonawane shall be released on bail in connection with Crime No.639/2025 registered at Police Station Katol, District Nagpur for the offences punishable under Sections 109, 115(2), 118(1), 189(2), 190, 193(3) of the Bharatiya Nyaya Sanhita, 2023, on furnishing P.R. Bond of Rs.25,000/- each with one solvent surety each in the like amount.
iii] The applicants shall not in any way tamper with the prosecution evidence.
iv] The applicants shall not pressurize or threaten the prosecution witnesses.
v] The applicants shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.
vi] The applicants shall co-operate the investigation officer.
The Criminal applications are disposed of accordingly.
