Heard.
The State Govt. has imposed prohibition in the district of Chandrapur. Despite that, liquor is smuggled to the district from other neighbouring districts. The applicant in this application is a habitual smuggler of liquor in spite of prohibition. In his order, the Trial Judge has observed thus in respect of present Applicant:- "2.
............................................................ ............Perused the CIS report which shows that including present case, earlier two cases were pending against accused. All these aspects show that accused is habitual offender and indulging in similar type of offences time and again and hence not entitled for any mercy and his application stands rejected."
I agree with the above reasons.
Hence Criminal Application [ABA] No. 575 of 2015 is rejected.
