Heard petitioner in person and learned counsel for the respondent.

By this application, petitioner seeks access to meet his daughter during Diwali festival by obtaining her custody from respondent during the period from 7th of November, 2015 to 15th of November, 2015. Admittedly, by the orders passed by learned Family Court access is already given to the petitioner on 1st and 3rd Saturday for two hours before the Family Court. According to the petitioner, in spite of orders same are not complied with.

Learned counsel for the respondent has placed on record the document which prima facie establishes that the order is being complied.

Considering the fact that the Family Court is having Diwali Vacation and are closed, it would not be possible to allow application for granting access, as prayed.

In that view of the matter, petitioner is allowed to access to his daughter Bhumika in the Family Court on 16th of November, 2015, after her school, from 3 p.m. to 5 p.m.

Petitioner is allowed to handover any gift whatsoever
