12th September, 2018 Upon instructions from the applicant, the learned counsel makes a motion for withdrawal of the present Criminal Application.

Criminal Application stands dismissed as withdrawn with liberty to approach the Sessions Court with a prayer for modification of the order dated 23rd August, 2018 passed in Misc. Bail Application No. 130 of 2018 decided by the Additional Sessions Judge, Kelapur. It is clarified that compliance of the Condition No. [i] in the aforesaid order be not insisted till 24th September, 2018. It is made clear that this Court has not examined the merits of the matter and the learned Sessions Court shall deal with the application for modification, if so preferred, without being influenced by aforesaid order.

Steno copy of this order be supplied to learned counsel for the applicant as per rules.
