By this petition, the petitioner impugns the order of the respondent-Society, dated 30/09/2015 transferring the petitioner from the Ashram School at Wanjri (Pod) to the Ashram School Akola Bazar, Tahsil and District Yavatmal.
According to the petitioner, the petitioner could not have been transferred from one Ashram School to another on the basis of a resolution passed by the Gram Panchayat that the petitioner should be transferred. It is stated that the petitioner could not have been transferred on the basis of the complaints made by the local residents. It is stated that the complaints annexed to the petition clearly show that they are as vague as they could be and the respondent-Management could not have taken action against the petitioner on the basis of the said complaints. Shri Narwade, the learned counsel for the Management, states on instructions that though there may be a reference to the resolution of the Gram Panchayat in the impugned order, dated 30/09/2015, the petitioner is not transferred on the basis of the
wp6099.15 2/2 same and the petitioner has been transferred, in view of administrative exigency as the petitioner is the senior most teacher. It is stated that the Ashram School at Wanjri (Pod) is at a small distance from the Ashram School at Akola Bazar and the petitioner should not make a grievance about his transfer. In the circumstances of the case, we are not inclined to interfere with the order of the transfer. The writ petition is disposed of with no order as to costs.
