By this application, the applicant prays to set aside the order dated 08.08.2023 passed by the Registrar (judicial) dismissing the application against the respondent no.1.

It is seen from the record that due to non-filing of affidavit of service against respondent no.1 within stipulated period, the order came to be filed in the matter. 3.

The applicant states that in case the order is revoked, he will take necessary steps to serve the respondent no.1 in the matter. He also moved another application for permission to serve the respondent no. 1 by substitute service. 4.

In view of this the application is allowed. The order passed by the Registrar (Judicial) dated 08.08.2023 is hereby quash and set aside. The application is restored against the respondent no.1.

CIVIL APPLICATION NO. 1048 OF 2025 5.

By this application, the applicant seeks leave to serve the respondent no. 1 by alternate mode i.e. paper publication in daily news paper 'Dainik Bhaskar.

For the reasons stated in the application, the application is allowed.
