The petition was filed with a grievance that though there are various surplus teachers in various schools on grant-in-aid basis, without absorbing the said surplus teachers, the Management of various schools were indulging into recruitment process.

In the affidavit filed on behalf of the respondent nos. 1,4,5 and 6, it has been categorically stated that if any appointments are made by the Management without accommodating the surplus teachers, the salary of such teachers would not be paid by the public exchequer.
