This is an application by applicant husband for grant of anticipatory bail in Crime No.205 of 2016 registered for the offence punishable under Section 498-A read with Section 34 of the Indian Penal Code. Applicant is protected by interim orders of this Court from his arrest by order dated 26.10.2016 and was directed to attend investigating officer. Admittedly, applicant has attended investigating officer in compliance to the same order.
Learned counsel for the applicant submits that in the meantime, the issue is amicably settled between applicant and his wife in a proceeding initiated by wife for grant of decree of divorce by mutual consent before learned Family Court and both parties had entered into agreement wherein one of the conditions .....2/-
agreed is that parties will take necessary steps by filing application for quashing of F.I.R. No.205 of 2016 out of which present application arose.
The copy of the said terms is taken on record.
In that view of the matter, interim protection granted to the applicant stands confirmed on same terms and conditions with further direction to applicant to attend investigating officer, if called, till filing of the charge-sheet.
