Apprehending arrest in connection with Crime No.134/2018 registered by the non-applicant for the offence punishable under Section 379 of the Indian Penal Code, the applicant seeks pre-arrest bail. The complaint is lodged by father of applicant about theft of three sprinklers. The facts on record show that there is some dispute in the family regarding shares in respect of family properties. The applicant claims to be a labour and has stated that any other crime / offence is not registered against him.

The investigating agency has not been able to point out that custodial interrogation of applicant is necessary for investigation.

In the facts of the case, interim order passed

2 aba646.18 by this Court on 11th September, 2018 is confirmed in terms of para (A) of the operative part of order. The application is allowed in the above terms.
