DATE : 07/10/2025 1) The applicant is apprehending his arrest in Crime No.226 of 2025 registered with Police Station Aheri, District Gadchiroli for the offence punishable under Section 65(a) of the Maharashtra Prohibition Act, 1949.

2) It is alleged that the information was received by the police that at Mouza Alapallai, near sport stadium one person along with four wheeler when reached near sport stadium, seeing police, left the four wheeler near wall compound of sport stadium and fled away by jumping the wall compound.

2 / 4 13-aba 686-25 3) The police inspected the four wheeler and found 30 boxes of country made liquor valued @ Rs. 24,000/- , and all other boxes were seized. The learned counsel appearing for the applicant has stated that the applicant is the owner of the vehicle. He was not on the spot. The liquor is already seized. He has filed additional affidavit mentioning the details of the crime, which are registered against the applicant. Only because, he is the owner of the vehicle and the liquor is seized, the custodial interrogations of this applicant is not necessary. Hence prayed to protect him by granting anticipatory bail.

4) The learned APP has opposed the application stating that the applicant is doing this liquor business in the Gadchiroli district, where the liquor is banned. Earlier also offences are registered against him. The custodial interrogation of this applicant is necessary to verify from where he is bringing huge quantity of country liquor. Hence, prayed to reject the application.

5) Heard both the sides.

6) The allegations against this applicant are about transporting the illegal liquor in banned area. The applicant has disclosed about earlier offences registered against him. In one of the offence bearing Crime No.924 of 2021, he is

3 / 4 13-aba 686-25 acquitted. The vehicle which is owned by this applicant is used in the said offence. Considering the role of this applicant and as the liquor is already seized, custodial interrogation of this applicant is not required. The case is made out to release the applicant by granting him anticipatory bail.

Accordingly, I pass following order:

i] It is directed that in the event of arrest of the applicant-Ashish Ramesh Mitpalliwar in connection with Crime No.226 of 2025 registered with Police Station Aheri, District Gadchiroli for the offence punishable under Section 65(a) of the Maharashtra Prohibition Act, 1949 shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Thousand with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.

v] The applicant shall co-operate the investigation officer.
