The applicant is seeking pre-arrest bail in Crime No.863 of 2022, registered with Police Station: Arni, District: Yavatmal, for the offences punishable under Sections 188, 272, 273 and 328 of the Indian Penal Code and Sections 30(2)(a), 27(3)(e), 26(2)(i) and 59 of Food Safety and Standards Act.

In this case though the contraband was not recovered or seized from the applicant however, in the investigation it has come that the contraband were supplied by the applicant. There are antecedents of similar nature. The learned APP has pointed out from the crime chart that there are seven cases of similar nature are registered against the present applicant.

Thus, it appears that the applicant is habitual offender and therefore, there is every possibility that if the applicant is released on bail, he may repeat the offence. Moreover, to have a deterrence, I am not inclined to grant bail. Accordingly, I pass the following order: The criminal application is rejected.
