Shri Anil Padiyar, learned counsel for the applicant/ intervenor, Shri R.S. Kurekar, learned counsel for the original petitioner and Shri A.V. Khare, learned counsel for the respondent.

Shri Kurekar, learned counsel seeks time to file reply to the civil application.

Shri Padiyar, learned counsel points out that the proposed applicant/ intervenor is a lead Banker and, therefore, very much interested in adjudication of controversy. The property involved already forms subject matter of proceedings before the Debts Recovery Tribunal at Ahmedabad.

Shri Khare, learned counsel has no objection if the prayer in the application is granted.

In this situation, without prejudice to defences

0103caw2441.16 available to the petitioner in the matter, we allow the applicant/ intervenor to be added as respondent No. 2 in the matter. The necessary amendment be carried out within one week.

Liberty to the added applicant/ intervenor to file its additional reply, if any, within a further period of one week.

List the matter on 15.03.2017.
