Apprehending arrest in connection with Crime No.165/2018 registered by the non-applicant for the offence punishable under Sections 307, 143 and 506 of the Indian Penal Code, the applicants seek pre-arrest bail.

The facts on record show that there is some dispute between the informant and the applicants in respect of agricultural land. The crime is registered against the applicants on the complaint of the informant that when he had gone to the agricultural land, all the accused assaulted the informant and the applicant No.3 (aged about 82 years) administered poison to the informant.

The applicant Nos.1 and 2, aged about 42 and 51 years, claim to be agriculturist and applicant No.3,

2 aba651.18 aged about 82 years, claims to be a retired teacher. The applicants have stated that any other crime / offence is not registered against them.

By order dated 12th September, 2018 this Court has granted interim protection to the applicants imposing condition of attendance on the applicants. The investigating agency has not made any complaint that the applicants have not co-operated in investigation and / or have not attended the police station on the dates as directed by this Court. The investigating agency has not been able to point out that custodial interrogation of applicants is necessary for further investigation. In the facts of the case, interim order dated 12th September, 2018 granting provisional pre-arrest bail to the applicants is confirmed on the same terms and conditions. The application is allowed in the above terms.
