2] The respondent No.1 has filed the pursis. The contents of which are produced below.
"1] In view of the specific stand of petitioner that " Master of Computer Management and Master of Computer Application are allied courses and hence the total teaching experience of the petitioner was required to be taken in to account" and another contention that " subject statistics is the integral part of M.C.A. course as well as M.C.M. course & the curriculum of M.C.A.
course contains statistics and operation research as subjects" etc., the University undertakes to withdraw the impugned order Dt. 08.09.2017 & matter will be referred to competent authority i.e. respondent No. 3 AICTE for necessary guidance in this behalf, within period of 2 weeks.
wp6599.17.O.odt 2] On receipt of guidance from AICTE, a fresh decision about the approval to the appointment of petitioner as Professor will be taken within 4 weeks. In view of this position, the instant petition can be disposed of by directing the respondent No.3 AICTE to take appropriate decision on the proposal to be submitted by University in this behalf, within reasonable period."
3] In view of the aforesaid pursis, the order impugned in the petition dated 08.09.2017 has been withdrawn and the matter is being referred to AICTE for necessary guidance.
4] In view of this, the grievance of the petitioner does not survive. However, we keep all the questions open referred in the competency of AICTE to decide the question referred to it.
5] The petition stands disposed of.
