During the pendency of the present application from last two years, no steps were taken to get the matter decided at the earliest. In the meantime, chargesheet is ready after completion of the investigation and therefore a request is made by this application to file the chargesheet. Considering the fact that the investigation is over and chargesheet is ready, we are of the opinion that in the above referred backdrop, permission needs to be granted to file chargesheet. Accordingly, the permission is granted. Criminal Application (APL) No.1418/2023 Since we have permitted the State to file chargesheet, we grant permission to learned Counsel for the applicant to withdraw the present application with liberty to file afresh for raising challenge to the chargesheet.
