CORAM

: SIDDHESHWAR S. THOMBRE, J.

DATE : 17 th N OVEMBER , 2025 .

1.

Heard learned counsels appearing for the parties. 2.

The petitioners assail the order dated 05.07.2019 passed in SCS No.665 of 2016 by the 3rd Joint Civil Judge Senior Division, Nagpur, whereby the learned Trial Court allowed the application below Exhibit - 21 filed by the respondents - original plaintiffs under Order 6 Rule 17 of the Code of Civil Procedure, 1908. 3.

I have gone through the order passed by the learned Trial Court wherein, it has observed that if the proposed amendment is allowed, it does not change the nature of the suit. Therefore, in my view, the order passed by the learned Trial Court is well reasoned order and I do not find any reason to interfere with the said order under Article 227 of the Constitution.

4.

Both the parties have submitted that the suit is of the year 2016. In view thereof, the learned Trial Court to

24 WP-6926-2019 decide the suit within the period of one year from today. 5.

In view of that the petition stands dismissed. (SIDDHESHWAR S. THOMBRE, J.) TAMBE
