The issue in the present petition is already concluded by the judgment of the Division Bench of this Court in the case of Shri Vivek Brajendra Singh .vs. State Government of Maharashtra & others reported in 2012(3) ALL M R 130. The S.L.P. challenging the same is also rejected by the Hon'ble Apex Court.

In that view of the matter, the present petition is also rejected.
