The petitioner which is a District Labour Co-operative Society seeks to raise a challenge to the communication dated 18.11.2022 that has been issued by the Divisional Joint Registrar, Co-operative Societies, Amravati to the District Deputy Registrar, Co-operative Societies, Yavatmal in which it has been stated that a Labour Co-operative Society can be issued a solvency certificate either by the District Labour Societies Federation or the District Deputy Registrar. The petitioner apprehends that despite availability of the Federation it is likely that the District Deputy Registrar may issue such solvency certificates without verifying the credentials and without having sufficient staff to ascertain the solvency.

We find that such challenge in the absence of any material particulars and without indicating the absence of statutory powers to issue the impugned communication cannot succeed. In case the petitioner is aggrieved by the grant of solvency certificate to any Labour Co-operative Society, it is free to challenge the same in accordance with law.
