2/3 ORAL JUDGMENT (Per A.S.CHANDURKAR, J.) Rule. Rule made returnable forthwith and heard the learned counsel for the parties.

The petitioner was appointed as 'Shikshan Sevak' on 05.11.2001 and after completion of probation she was confirmed as physical teacher. Her services were duly approved. On the petitioner's attaining the status of seniormost physical teacher at the schools run by the respondent no.2-Society, she sought consideration of her case for promotion on the post of Head Master (Head Mistress). On 01.09.2019 however the petitioner was given temporary charge of the post of Head Master (Head Mistress). Being aggrieved the petitioner has filed this writ petition praying that the respondent no.2 be directed to forward a proposal treating the petitioner as holding the post of Head Master (Head Mistress).

During the pendency of the writ petition, the respondent no.2 on 07.04.2022 has issued an order in favour of the petitioner stating therein that by virtue of Resolution No.2 dated 06.04.2022 passed by the Management, the petitioner stands promoted on the post of 'Head Master' (Head Mistress) from 01.09.2019. A copy thereof has been issued to the Education Officer (Secondary), Zilla Parishad, Wardha.

In these facts, the writ petition is disposed of by directing the Education Officer (Secondary), Zilla Parishad, Wardha, to consider the proposal submitted by the Management seeking approval to the promotion of the petitioner on the post of Head Master (Head Mistress). The same be done within a period of four weeks from today in accordance with law. Decision taken on the proposal be communicated to the petitioner and the respondent no.2.
