CAO No. 1391 of 2023 in XOB No. 21/2021 in First Appeal No. 77 of 2021 Coram : Registrar(Judicial) Dated : 07.11.2023 This application is filed under Order 5 Rule 20 of the Code of Civil Procedure, 1908, for substituted service upon respondent nos.1 and 2 by paper publication. It is stated in the application that the notice issued to the aforesaid respondents returned back unserved for want of correct address.

It is further stated that on two occasions notice could not be served upon the aforesaid respondents and they are avoiding the service of notice and no other address except the present one is available with the applicant. The applicant thus prays for substituted service upon aforesaid respondents.

Considering the reasons mentioned in the application and the bailiff report, the applicant is allowed to serve aforesaid respondents by substituted service on last known address.

Substituted service be effected upon aforesaid respondent nos.1 and 2 by publishing a notice in widely circulated local daily newspaper where the aforesaid respondents are lastly known to have resided, in terms of Order 5 Rule 20 (1-A) of CPC, returnable within four weeks from the date of publication of notice.

First Appeal No. 77 of 2021 Two weeks time is granted for taking steps against respondent nos. 2 & 3.
