DATED : 23 rd September, 2019 CRI. WRIT PETITION NO. 914/2018.
Heard.
This petition is filed on 10th September 2018. The petitioner has prayed for directions to re-investigate in crime No.0067/2017. Learned A.P.P. has pointed out that the charge-sheet is filed on 17th February 2018, against 13 accused for the offences punishable under Sections 143, 147, 149, 324, 188, 427 and 506 of the Indian Penal Code. On 03rd January 2019, when the petition was listed before this Court, the petitioner was granted two weeks time to remove the office objections.
When the matter was listed before the Court on
2 WP914.18 21st June 2019, none appeared for the petitioner. Today again none appears for the petitioner.
With the assistance of learned A.P.P., we have examined documents placed on record of the petition. We find that this is not a fit case for exercising extraordinary jurisdiction under Articles 226 and 227 of the Constitution of India.
After filing of the charge-sheet, the petitioner will be at liberty to file application before the trial Court praying for discharge.
With the above observations, the petition is dismissed.
CRI. APPLN. NO. 270/2018.
In view of dismissal of the writ petition, the application praying for dispensing with office objections does not survive. Hence, it is disposed.
