Heard.

There is no explanation why cheque for the amount of Rs.24,42,000/- was credited by an unknown person in the account of the petitioner. The only excuse offered by the petitioner is, they have immediately returned back the amount to its owner. The entry in the bank account taken on next day is being relied.

We find that disputed questions arise and at this stage no case is made out warranting interference in extraordinary jurisdiction.

Keeping all the rival contentions open, we dispose of the criminal application.
