Heard.

The applicant was arrested in the crime in question, on 29th October, 2015 and presently he is in jail and, as such, his police custody is not required.

The offences alleged against the applicant are under sections 65(E) and 83 of the Maharashtra Prohibition Act. Undoubtedly, in the wake of prohibition in the District of Chandrapur, the applicant is alleged to have been in possession of huge quantity of liquor. However, looking to the punishment provided under the Act, it would be appropriate to make the following order:

ORDER

1.

Criminal Application No. 861/2015 is allowed.

2.

The applicant be released on bail, on furnishing personal bond in the sum of Rs. 50,000/- (rupees fifty thousand) with lone surety in the like amount.
