DATE : 10/01/2023 By present application, the applicant is seeking relaxation in the condition that prohibit his entry in the territorial limits of Lonar Tahsil. The condition was so imposed because the applicant who is a practicing Advocate has himself made a statement that he could not enter the territorial limits of Lonar Tahsil till the conclusion of the trial. The learned counsel for the applicant submits that the statement was so made, when the charge-sheet was not filed. The circumstances has now changed. The chargesheet has been filed. The applicant' s father is not keeping well and would require applicant'

s support.

Learned counsel for the applicant submits that the co-accused, who has been released on bail were not put to such condition. Learned APP would admit such status.

It appears that the offence is outcome of family dispute pertaining to immovable property i.e. encroachment on some portion of agricultural land. 4.

Accordingly, the condition No.12 in para 12 of the order that restrict the applicant to enter in territorial limits of Lonar Tahsil stands relaxed with a rider that the applicant shall not indulge in any activity that would adversely affect the trial. 5.

The applicant has not pressed for relaxation in condition No.15 that puts restriction to go abroad.

Application is disposed of in above terms.
