The learned counsel for the appellant submits that in view of provisions of Section 34(3) of the Maharashtra Rent Control Act, 1999, the second appeal would not be tenable. He, therefore, seeks leave to withdraw the present proceedings with liberty to file appropriate proceedings for challenging the judgment dated 5.5.2014 passed in R.C.A.No. 7/2008.

Hence,the Civil application and Second Appeal are permitted to be withdrawn with liberty to file appropriate proceedings.

The points raised in the second appeal are kept open. Both the proceedings are disposed of accordingly. JUDGE Hirekhan
