Heard.

The applicant is apprehending his arrest in Crime No.54/2015 registered with Police Station, Armori, Dist. Gadchiroli for an offence punishable under Section 115 read with Section 302, 120-B of the IPC. Mr. Doifode, A.P.P. for the non applicantState states that evidence of the co-accused that the present applicant-Gopal had given Rs.4,000/- to the magician establishes his role as conspirator in the offence of commission of murder.

There is no other evidence except the evidence of the co-accused and in the absence of any other evidence, there is no reason to allow arrest of the applicant in the said crime.

That being so, I make the following order.

ORDER

(i) Criminal Application (ABA) No.608/2015 is allowed.

(ii) In the event of arrest in Crime No.54/2015 registered with Police Station, Armori, Dist. Gadchiroli, for an offence punishable under Sections 115 read with Section 302, 120-B of the IPC, the applicant-Gopal Laxminarayan Randive, be released on bail on he executing P.R. Bond in the sum of Rs.20,000/- with one surety in the like amount.

(iii) The applicant shall attend Police Station, Armori, Dist. Gadchiroli once in a week between 11.00 a.m. to 4.00 p.m.
