This Court, on 22/09/2022 by giving detailed reasons, rejected the criminal application of the applicant, for grant of bail.

Now, this successive application is filed on the ground that the wife and the mother of the applicant, are not keeping well.

After going through the medical certificates, it appears that even prior to the rejection of the application of the applicant, the mother and the wife of the applicant were taking medical treatment for their ailment. Whereas, at the time of earlier application, the only ground in respect of the ailment of the applicant was taken and nothing was argued and pointed out as regard ailment of his wife and mother.

Thus, successive application on such grounds which was already existing on the date of rejection of the application, cannot be entertained as change in circumstances. In the circumstances, the criminal application is rejected. JUDGE Signed By:RAJESH K NANDURKAR rkn
