By this application, the prayer is made to grant permission to withdraw entire amount deposited by the appellant to the registry of this court.

It is pointed out that this matter was placed before the Lok-Adalat wherein the appellant has withdrawn the appeal unconditionally. In view of this, there is no impediment to allow the present application. Hence, the application is allowed as prayed.

It is pointed out that original respondent no.1 has expired on 17.6.2016. It is also stated that respondent no.2 is the only legal heir of respondent no.1. Hence, there is no need to bring on record the legal heir of respondent no.1. In view of above, respondent no.2 is permitted to withdraw the amount which is lying to the registry of this court subject to satisfaction of Registrar (Judicial).
