Aggrieved by his conviction for the offence punishable under Section 302 of the Indian Penal Code the applicant has filed appeal under Section 374(2) of the Code of Criminal Procedure and Criminal Application No.711 of 2016 is moved for condoning delay of 180 days in preferring it.

We have heard advocate Shri Rai for the applicant and learned A.P.P. for the non-applicant.

The learned A.P.P. is seeking time to verify the facts. However, the applicant being in prison, we do not see any malafides. Accordingly the delay is condoned. CRI. APPEAL NO. /2016.
