Heard.
The applicant was arrested on 17.6.2015 and is in jail since then, in connection with Crime No. 263/2015 for offence punishable under Sections 363, 366, 376(2)(n), 342, 506 r/ws. 34 of the IPC along with Section 3 (1)(xii) of the SC & ST (Prevention of Atrocities) Act, 1989 registered at Ramnagar Police Station, Chandrapur.
It is not in dispute that the prosecutrix was aged about 19 years on the date of the alleged offence. It also appears from the perusal of the record that the prosecutrix had with the applicant for some days at Mumbai and thereafter the complaint in question was lodged. The applicant resides at Pimpalkhuti, Tq. Kelapur, Dist.Yavatmal; while the victim resides at Pandharakawada. I think, in the interest of prosecution, appropriate care can be taken by prohibiting the entry of the applicant in
03.12.ba.864.15 Pandharakawada. Hence, the following order:
ORDER
i)Criminal Application (BA) No. 864/2015 is allowed. ii)The applicant is ordered to be released on bail in connection with Crime No. 263/2015, upon his executing a personal bond in the sum of Rs. 20,000/- ( rupees twenty thousand ) with one surety in the like amount.
iii)The applicant shall not enter the village Pandharakwada during the course of the trial. iv)The applicant shall cooperate with the Investigation Officer as and when called for and shall not tamper with the prosecution evidence.
