DATED :- APRIL 15, 2024 The application for grant of bail filed under Section 439 of the Code of Criminal Procedure on the ground of delay in trial.

The applicant is arrested on 18/09/2017.

After going through the investigation papers and the rojnama placed on record seems that the trial is already part heard and five witnesses are already examined and six witnesses is for the cross-examination. 4.

Considering the applicant is behind bar since 2017, trial Court shall dispose of the trial within three months. The applicant is at liberty to file an application for bail if trial is not concluded within three months. 5.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file afresh after three months if trial is not concluded within three months.

Permission is granted to withdraw the application.
