DATE :- 16th MARCH, 2023 The petitioner claims to be the owner of land admeasuring 3 H 61 R from Survey No.257, Mouza Khemjai.

A portion of that land admeasuring 2 H 80 R was acquired for construction of Water Tank and hence the land to the extent of 0.81 R is remaining with the petitioner. The learned counsel for the petitioner submits that the remaining land of the petitioner being affected by the construction of the Water Tank, he has suffered losses and is unable to undertake agricultural operations. Representations dated 29.06.2021 and 04.10.2021 have been made to the Sub-Divisional Officer of the Irrigation Department, Warora. According to the petitioner, the same have not yet been considered.

In view of above, the writ petition is disposed of by directing the respondent no.2 to consider the petitioner's representations dated 29.06.2021 and 04.10.2021 and take a decision thereon within a period of six weeks of receiving copy of this order. Decision taken be communicated to the petitioner. In case the grievance of the petitioner subsists, he is free to invoke appropriate remedy in accordance with law.

Order accordingly. No costs.
