IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH AT NAGPUR WRIT PETITION NO. 6487 OF 2025 NALANI MAKHRAM RATHOD ...Vs...

THE DIVISIONAL COMMISSIONER, AMRAVATI DIVISION, AMRAVATI AND OTHERS Office Notes, Office Memoranda of Coram, Appearances, Court's orders or directions and Registrar's orders Court's or Judge's orders Shri Kalyan Chiwarkar, Advocate for petitioner. Ms. Kalyani Marpakwar, AGP for respondent/State. CORAM: ANIL S. KILOR AND RAJNISH R. VYAS, JJ.

DATED : 17th OCTOBER, 2025.

The grievance raised in this petition is that the respondent no. 1 is not deciding the proceedings under Section 39(1)(i) of the Maharashtra Village Panchayats Act (for short, "M.V.P. Act"), despite the statute has made it mandatory to decide within a time bound manner. 2.

The prayers made in the petition are innocuous and accordingly, we are of the opinion that the petition can be disposed of with liberty to the respondent no. 1 to decide the proceedings under Section 29(1)(1) of the M.V.P. Act within four weeks from today.

3.

The learned counsel for the petitioner undertakes to communicate this order to the respondent no. 1 within one week.
